Most people who want to avoid probate create a living trust, which owns their assets and allows their families to transfer those assets after death with no intervention from the probate court. However, many assets do not go through probate regardless of how they are owned. For example, life insurance, annuities, IRA accounts and other retirement plans are not subject to probate. Property such as bank accounts, real estate, timeshares, vehicles, etc. are subject to probate and may not be owned by heirs until they have properly transferred.
